My Mom just recently met a guy online. They talked and got to know each other via email. They began talking in May, and met in July. I found out about him at the end of July after they met. The next thing I know, after meeting him only twice, I'm moving to Maryland with my Mom and Sister to live with him. I think they jumped into it incredibly fast. I did my best to tell my mom that I supported her, but didn't want to move. We argued sometimes about it. And sometimes I understood where she was coming from. Anyway, I just moved here after living in FL the majority of my life. My friends and my boyfriend live in FL, and leaving them was incredibly difficult. I'm 16, and I told myself, and my boyfriend, that I would move here and try it out for a few months. I'm doing my best to make the best of the situation. I'll be 17 in less then 2 months. My question is, at age 17, am I legally allowed to move out? My b/f's mom said i'm welcome to move with them. Can she be my guardian until i'm 18?At age 17, legally can I move out and live with a Guardian without being emancipated?
You can't move out at 17 in any state without parental permission. And even if your parents give you permission, there are all kinds of legal issues that would have to be considered/dealt with.
Without parental permission, it鈥檚 impossible. A judge will not award custody to a non-parent unless both parents are proven to be unfit, and nothing you said would be considered unfit parenting--maybe it's not 'smart' parenting, but it's not 'unfit'. Even in a case where the parents are unfit, no judge is going to award custody to the minor's boyfriend鈥檚 parents. They would either award custody to one of the minor's relatives or would place the minor in the custody of the state.
By the way, you wouldn't be able to get emancipated in this situation either.
The law varies from state to state. You're in a tough spot, but you'll work it out. Consult a legal aid office in your area.At age 17, legally can I move out and live with a Guardian without being emancipated?
Legally your mom is your guardian until you are 18, if she gives permission you can move out but she is still legally responsible for you.
For example if you can't support yourself and collect some form of financial assistance they will claw it back from her until your no longer a minor.
Until your 18 you can't even sign a legal contract because you can't be held to it.
Why not stick around until your 18, it's only a year, you can still stay in contact with your friends and who knows you just may like where they move and meet a lot of nice people.
Don't keep your life in a bubble by insisting on staying in one place, the world has a lot to offer, experience as much of it as you can while your still young. You can always change your mind when your 18.
The answer is no, unless your parent/legal guardian agrees that you move out, they can report you as a runaway and have the police arrest you and bring you home. Besides, your boyfriend's mom would be charged with harboring a runaway, which is a jail sentence. The only time you can move out is when you are 18 and not a day before that. Good luck to you!At age 17, legally can I move out and live with a Guardian without being emancipated?
If your mom gives you permission, you can move wherever you want, but she would still be responsible for you as your legal guardian. Your bf's mom would just be like a temporary caretaker.
